Who generally wins child custody battles?

Child custody battles take place when parents, who have children that are not yet adults, undergo a divorce and can’t agree what to do about the children. A decision must be made as to which parent should have custody of the children.

The court will usually rule in favour of the parent that can offer the child the most consistency, reliability, stability and the best opportunity to have a better future.

A lot of times the mother will gain custody of her children because the father may not have a work schedule that makes it realistic for him to have custody. It is more likely for men to not have custody of their children compared to women, and if the man is physically abusive, the woman usually gains custody.

However, the sex of the parent does not always lead to who gets custody. Dr. Ira Turkat is a psychologist who knows child custody battles and is an expert in child custody litigation. He understands that is not necessarily the sex of the parent that determines the result, but it is what the parents can offer their children that plays an important role in the final legal decision.

If the court decides it is in the best interests of the children to go with the father then that is the decision the court will make. If it is in the best interest of the children to go with the mother then that is the decision to court will make.
